FRA Opinion on Data protection reform package

At the request of the European Parliament, FRA has published an Opinion on fundamental rights issues associated with the Data protection reform package

The EU Fundamental Rights Agency has published an Opinion on fundamental rights issues associated with the Commission proposals for a General Data Protection Regulation (COM(2012)0011) and a Data Protection Directive (COM(2012)0010).

The key objective of the reform package is to strengthen the internal market while ensuring effective protection of the fundamental rights of individuals, in particular their right to data protection.

While welcoming the reform package, the FRA has made a number of suggestions to improve the interaction between the data protection and other rights enshrined in the EU’s Charter of Fundamental Rights. The Opinion thus addresses the need to balance the right to the protection of personal data with other fundamental rights guaranteed by the Charter, and analyses the protection of special categories of data in more detail. It has also examined the ability of the safeguards envisaged in the reform package to ensure effective access to justice for everyone in the field of data protection.
