The Advocate General's Opinion in the Preliminary Reference in the Chacon Case was published on 16 March 2006 and is available on the Court of Justice's Website below. The AG gives his opinion on whether Directive 2000/78 and in particular the protection from discrimination on the grounds of disability includes within its protective scope an employee who has been dismissed by her employer due to illness. The AG's opinion is not binding on the Court of Justice which will give its judgment in the case in due course.
