Situation Testing in anti-discrimination cases: MPG embarks on a new research project

The Migration Policy Group (MPG) carries out a research project to raise awareness and gather data on Situation Testing.

Building upon a report called “Proving Discrimination Cases, the Role of Situation Testing,” recently published by the Migration Policy Group (MPG),  and the Swedish Centre for Equal Rights, a research project led by MPG is currently being developed in France, Belgium and Hungary, countries selected due to their wide experience on situation testing, its acceptance by courts as a mean of evidence and its multiple uses in various circumstances.

The objective of this research project is to raise awareness of the technique of situation testing, discuss its uses and benefits   for purposes other than litigation as well as how it can serve as a monitoring, awareness-raising and advocacy tool, finally concluding on the best way to expand its application. This independent non-profit European organisation will work with national experts from these countries and consult the national Equality bodies and NGOs from all EU Member States.

The first stage of the project involves an online consultation, which focuses on the concerns Equality bodies and NGOs have on situation testing and what they would like to see resolved at legislative and practical level. A workshop will take place in Brussels in the Autumn of 2009 where a coordinated approach to using situation testing at its full potential will be adopted; the draft Analytical Report including the findings and the recommendations, as well as the Model legislation, will be presented and discussed with experts and stakeholders from the three countries. These documents will lead to a publication complementing the recent Handbook on Situation Testing.
